TERMS OF SERVICE

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. By registering, you represent that you meet this requirement and that all information you provide is accurate.

2. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately if you suspect unauthorized use of your account.

3. User-Submitted Content

The Site allows fighters, coaches, and promoters to submit profiles, photos, gym pages, match information, and related content ("User Content"). By submitting User Content, you represent that:

• You own the rights to it, or have permission to post it.
• It is accurate to the best of your knowledge.
• It does not violate any law or the rights of any third party.

3.1 Content Standards

You agree not to submit content that is profane, obscene, harassing, foolish, a joke or prank submission, knowingly false, misleading, libelous, defamatory, or otherwise not a good-faith, serious representation of yourself, your gym, or your event. The Site is intended for legitimate, professional use by fighters, coaches, and promoters — not for parody, impersonation, or content intended to mock, harass, or misrepresent any individual or organization.

We reserve the right, but not the obligation, to review, edit, refuse, or remove any User Content, and to suspend or terminate any account, at our sole discretion and without prior notice, if we believe this section has been violated.

4. Content/Moderation & Removal

We may use automated tools and/or manual review to screen submissions. Content may be removed, and accounts may be suspended or deleted, without prior notice if content is found to violate these Terms. We are not obligated to provide a reason for removal, though we may do so at our discretion. Users may appeal a removal or suspension by contacting us at admin@thesmokerapp.com.

5. Prohibited Conduct

In addition to the content standards above, you agree not to:

• Impersonate any person or entity, or misrepresent your affiliation with any gym, promotion, or fighter.
• Upload content that infringes intellectual property or privacy rights of others.
• Use the Site to harass, threaten, or defame any individual.
• Attempt to interfere with the security or normal operation of the Site.

6. No Guarantee of Accuracy

Fight records, match results, gym information, and profile details are submitted by users. We do not independently verify this information and make no guarantee as to its accuracy. Use of this information for betting, matchmaking, or any other purpose is at your own risk.

7. Disclaimer of Warranties

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

8. Limitation of Liability

To the fullest extent permitted by law, the Smoker App and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Site or reliance on any content posted on it — including but not limited to content that is inaccurate, defamatory, or offensive, and including any injury, dispute, or loss connected to fights, matches, or events organized or advertised through the Site.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Smoker App, its owners, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

10. Termination

We may suspend or terminate your account and access to the Site at any time, with or without cause, and with or without notice. You may also delete your account at any time by contacting us.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.
